3. Booking and Reservation Policies

3.1 General Booking Terms

When you make a booking through our Site:

  • You agree to provide accurate and complete information for all travelers
  • You confirm that you have the authority to accept these Terms on behalf of all travelers in your booking
  • You agree to pay all fees, taxes, and charges associated with your booking
  • You understand that certain bookings may be subject to additional terms and conditions imposed by travel suppliers (airlines, hotels, tour operators, etc.)

3.2 Pricing and Payment

All prices listed on our Site are in Canadian dollars unless otherwise specified. Prices are subject to change without notice until a booking is confirmed.

Payment terms:

  • Full payment or a deposit (as specified) is required to confirm a booking
  • If a deposit is paid, the remaining balance must be paid by the due date specified in your booking confirmation
  • If payment is not received by the due date, we reserve the right to cancel your booking and apply cancellation charges

3.3 Cancellations and Refunds

Cancellation policies vary depending on the type of service booked and our travel suppliers' terms. Specific cancellation policies will be provided during the booking process.

Generally:

  • Cancellations must be made in writing (email is acceptable)
  • Cancellation fees may apply based on when the cancellation is made
  • Some bookings may be non-refundable or subject to penalties
  • Refunds, when applicable, will be processed to the original form of payment

3.4 Travel Documentation

You are responsible for ensuring that you and all travelers in your booking have the necessary travel documentation, including:

  • Valid passports with adequate validity beyond your travel dates
  • Visas or other entry permits for your destination(s)
  • Travel insurance documentation
  • Vaccination certificates or health requirements for your destination(s)

Canadian Explorer is not responsible for any issues arising from inadequate travel documentation.

4. Intellectual Property

4.1 Ownership

The Site and all of its content, including but not limited to text, graphics, logos, images, photographs, videos, software, and code (collectively, "Content"), are the property of Canadian Explorer or our licensors and are protected by copyright, trademark, and other intellectual property laws.

4.2 Limited License

We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Site and Content for personal, non-commercial purposes. This license is subject to these Terms and does not include:

  • Use of the Site or Content for any commercial purpose
  • Modification, reproduction, distribution, or public display of the Site or Content
  • Any attempt to decompile, reverse engineer, or disassemble any software contained on the Site
  • Removing any copyright, trademark, or other proprietary notices
  • Using the Site or Content in any manner that may infringe upon the intellectual property rights of others

4.3 User Content

Canadian Explorer does not warrant that:

  • The Site is free of viruses or other harmful components
  • The results of using the Site will meet your requirements

5.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CANADIAN EXPLORER, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SITE.

CANADIAN EXPLORER'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING OR USING THE SITE DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE DATE OF THE CLAIM.

5.3 Third-Party Content and Links

The Site may contain links to third-party websites, services, or content that are not owned or controlled by Canadian Explorer. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. 6. Indemnification

You agree to defend, indemnify, and hold harmless Canadian Explorer, its affiliates, officers, directors, employees, agents, suppliers, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Site, including, but not limited to, any use of the Site's content other than as expressly authorized in these Terms.

7. Governing Law and Dispute Resolution

7.1 Governing Law

These Terms and your use of the Site shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.

7.2 Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to these Terms or the breach, termination, or validity thereof shall be settled by arbitration in accordance with the arbitration rules of British Columbia. The arbitration shall be conducted in Vancouver, British Columbia, in the English language.

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction.

8. General Provisions

8.1 Entire Agreement

These Terms, together with our Privacy Policy and any other agreements or policies referenced herein, constitute the entire agreement between you and Canadian Explorer regarding your use of the Site and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral.

8.2 Severability

If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole, and such provision shall be deleted without affecting the remaining provisions.

8.3 Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and Canadian Explorer's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

8.4 Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without Canadian Explorer's prior written consent. Any attempt by you to assign or transfer these Terms without such consent will be null and void. Canadian Explorer may freely assign or transfer these Terms without restriction.
